This is yet another knock-on effect of congress essentially handcuffing itself to the radiator. Nothing can get done without 60 senators to force cloture, but the country still needs governing, so over time the courts have stepped in with rulings that essentially bend the law to what it needs to be and POTUS power has expanded everywhere possible. Congress had adopted the idea that its primary role is not to govern, but to put a stop to governing.
