This will be interesting to see play out. I agree with Mr. Goldman's take that putting the gray text "user agreement" in the lower corner does nothing.

I can load the page and view the information without interacting with said agreement; therefore, I certainly didn't agree and may not even have been aware.

Reminds me of people who ran Hotline servers back in the day, except before the server would let you connect you'd be shown a modal with an agree or disagree. Websites with that type of User Agreement might have more to stand on, but even then I'm not so sure.
