The Supreme Court has held that retaliatory violations of the first amendment allow the victim to sue the offender personally. At least twice last year, the current members of the Supreme Court threw out lower court rulings that gave qualified immunity to government officials accused of arresting people for saying things they didn’t like.

So, you know, this may not be a “fizzling out” so much as a boomerang that comes back and knocks your teeth out.
