We must (socially) assume all arrests are US citizens by default, and it is up to the Florida/federal government to assert otherwise on an individual basis.

What you describe is the principle of presumption of innocence. Shame it seems to be a lost concept in the land of the free nowadays.

I feel it goes a bit beyond that, because at this point it's also the presumption that those governments are operating recklessly and with knowing dishonestly.

You could argue that presuming you're an alien implies that rights given by law don't necessarily apply to you. It's far worse than being presumed guilty.
