What he doesn't say is that it benefits governments to allow this situation. Companies can spy on the public in a way which is illegal for governments to do so. In return, they are given massive tax breaks. It isn't "neoliberal" at all, since that presupposes an actual free market not the heavy government interference and tax discrimination we have.
