Why is or why should OpenAI not be open to legal liability here? Any human who did the same would be.

Section 230 of US law only provides immunity for online publishing of "user generated" content. AI slop clearly goes beyond the bounds of "user generated" in my opinion.

AI is a factory for these sort of liability issues.
