Judge orders release of man arrested in Minneapolis by ICE with a battering RAM

‘U.S. District Judge Jeffrey Bryan said in his ruling that the agents violated Garrison Gibson’s Fourth Amendment rights against unlawful search and seizure.

“To arrest him, Respondents forcibly entered Garrison G.’s home without his consent and without a judicial warrant,” he said.’

mullingitover•3w ago
Minnesota is a castle doctrine state. Seems wildly irresponsible to perform these home invasions under color of law, agents could end up shot and the courts will tell them they had it coming.
DustinEchoes•3w ago
If an agent gets shot in MN, Trump will invoke the insurrection act by the end of the day.
willmarch•3w ago
He’s going to do it either way, that’s the whole point of the attack on Minnesota
red-iron-pine•3w ago
like he's already talking about it, and suspending mid-term elections -- and no ICE agent has been killed yet.

it's coming regardless of if the USA-ians choose to play ball or not

general1465•3w ago
And what is expected to happen? National Guard will come in and then will figure out that ICE agents are source of unrest and kicks them out? That would be kind of embarrassing outcome.
tencentshill•3w ago
This particular constitutional violation was against an individual not permitted to own firearms. Non-citizens would be the least risky group to target for home invasions for this reason.
Steven420•3w ago
Homeland security is saying "Tricia McLaughlin, a spokesperson for the Homeland Security Department, had said that Gibson has “a lengthy rap sheet (that) includes robbery, drug possession with intent to sell, possession of a deadly weapon, malicious destruction and theft.” She did not indicate if those were arrests, charges or convictions."

So the man may have still been dangerous. People who own firearms legally are the less dangerous than those who possess them illegally. Although it's not clear what type of dangerous weapon the man had.

willmarch•3w ago
You can’t take anything this administration says at face value. They have a pattern of blatant lies.

Below the section you chose to quote:

‘Court records indicate Gibson’s legal history shows only the one felony in 2008 (later dismissed by the court), along with a few traffic violations, minor drug arrests and an arrest for riding public transportation without paying the fare.’

justinclift•3w ago
The statement in the article directly below that pointed out that Tricia McLaughlin's statement was utter bullshit.
justinclift•3w ago
> This particular constitutional violation was against an individual not permitted to own firearms.

So, firearms are off the table for that person. How about alternatives that aren't gunpowder based (bows, crossbows, creative mantraps, etc)? :)

innagadadavida•3w ago
This is interesting, so for a non white legal resident, just carrying your firearm around these people is sufficient to signal that you should be left alone.
scarecrowbob•3w ago
This is why folks talk about organization around guns. If it's a homeowner with a firearm and some singular criminal (which I feel is so vanishingly rare as to practically only exist in NRA supporters fantasies) then exercising the castle doctrine seems reasonable.

If it's you versus the entire US state effectively standing on your doorstep with a battering ram, it feel like there are plenty of obvious cases ranging from "the average black experience" to "Ruby Ridge and Waco" which demonstrate that after the government has murdered you it's hard to remedy that fact in court.

I think ICE is relying on that, which given historical precedent seems rational (even if it's not ethical).

However, you would probably be right if you pointed out that they are rapidly starting to operate in unprecedented territory.

It's possible that once they start trying to harass organized protestors and activists instead of individuals they might find themselves in much different situations, unable to find a handy person like William O'Neal (who helped murder Fred Hampton) to set things up for them.
