This reads like prosecution driven by outrage at the death of a child and some perverse desire to punish someone / anyone ... but just perpetrating more injustice.

I guess the NY Times is too chicken to say it outright, but this prosecution looks racially motivated. He was crossing the street with his brother and the driver who struck the child was not charged. (Cue comments about the technicalities of jaywalking)
