How is this not fraud? If a stock exchange faked availability this way, they'd go to jail.

Personally I think it is a fraud but legally I'm not aware of any law that make this situation a fraud.
Of course a lawyer could use the same analogy you did in the court, but can you prove in the court they did it?
I know they did, you know they did, but prove it to the court is very difficult.

That's what discovery and witnesses are for. If you merely call the devs that implemented it to the stand, it is unlikely they'd be willing to commit perjury to cover for their bosses.
