Flo Health (menstrual tracker) lawsuit; SJ = Summary Judgement

>The settlement doesn’t include Flo Health Inc., which operates the app, and Meta Platforms Inc., which faces similar privacy claims. Both companies are still scheduled to face a jury trial later this month before Judge James Donato.

Thanks. Law is confusing. My “source” was simply the near top of the PDF by OP:

“ERICA FRASCO, et al., individually and on behalf of all others similarly situated, Plaintiffs, v. FLO HEALTH, INC., et al., Defendants.”

"The settlement doesn't include Flo Health Inc., which operates the app, and Meta Platforms Inc., which faces similar privacy claims."

The wiretapping claims (cf. privacy claims) against the other defendants, Flo and Meta, have been dismissed.

Getting wiretapping is nice, it unlocks a whole new set of remedies.

How far is it from the long arm of HIPAA? Flo sounds it should be, legally, a medical provider and consumers are only going to use more of these devices and services.
